Small Smiles Dental Centers’ last ditch effort to avoid trial has FAILED

After 2 years or more of stall tactics by attorney’s representing Small Smiles Dental Center defendants, the New York trials are set to begin in three weeks!  Yes, you heard me, three, count’em 1… 2,…3… weeks!  Yahoo!  Jury selection set to begin September 9, 2013.

Tuesday (August 14, 2013) the  court ruled against Small Smiles and defendants and their plea for a Summary Judgment — essentially telling the old boys to buckle-up, quit whining, they have you by the balls, be ready for trial or start writing checks. Small Smiles Dental Centers’ former dentists (17 in total) and that nasty DeRose crew in Colorado are in for a very bumpy ride.

These sweet children were hurt and abused and forevermore changed from as far back as 2006, and it’s finally making it to trial!  So, as a warning to all you dentists still employed there, don’t think your ass is out of a bind when you quit; cause it “ain’t”.  Not by a long shot!

Some of the dentists say the used their best medical judgment to provide dental care to the children suing them, but evidence indicates that isn’t even close.  In fact, it’s laughable! Evidence provided showed Koury Bonds, DDS and the others violated the “relevant standard on care” on several issues. 

According to the ruling, there is plenty of evidence these dentists prepared and recommend treatment without clinical justification and performed substandard care. 

They unnecessarily restrained children in papoose boards; extracted teeth that without clinical justification; failed to use local anesthetics, filled teeth that didn’t need to be filled; altering records; performing unnecessary baby root canals;(remember that $35 million dollar award a few weeks ago over unnecessary root canals?) failed to obtain proper informed consent for treatment from parents; just to name a few.  These guys knowingly and purposefully used informed consent forms that they knew did not meet the standards or guidelines of the American Academy of Pediatric Dentistry (AAPD).

Now, haven’t I been screaming this as loud as I can for some 6 years now.  Everything I’ve uncovered and reported here about this horrible place is being proven to be the truth, and it looks like it’s going to be told in front of a jury, pretty damn quickly.

In the ruling the Judge states, “There…is ample evidence from which a jury could concluded that the defendants perpetuated a fraud on the plaintiff by treatment him and other Small Smiles patients not to meet his medical needs but as a means to maximize profits for the dentists, corporations and Individual Defendants.” (the DeRose crew)

“Email correspondence… demonstrates the overriding emphasis on profits.”  One such email between Michael Roumph and the lead dentists in the Albany NY clinic states “[p]roduction per patient needs to improve.”

An engine problem appeared to have caused the Thursday night slide-off of a Learjet at Pueblo Memorial Airport, a preliminary report by the Federal Aviation Administration said.

The plane "lost power in right engine during take-off and ran off side of runway," the report said.

Due to weather conditions, investigators with the FAA and National Transportation Safety Board won't arrive in Pueblo until early next week, said Mark Lovin, airport director, on Friday.

No one was injured in the Thursday night crash. The private plane was occupied by the prominent DeRose family of Pueblo. The group was taking off in poor weather conditions to Las Vegas to watch the Super Bowl. Lovin, however, has said it doesn't appear the weather was a factor.

The report said the plane sustained "substantial damage" in the crash. The name of the pilot has not been released.

The DeRoses were on Learjet ID number N31WS, which was once owned by singer John Denver, according to flightaware.com

"John Denver took delivery of this Lear in 1975. He named it WindStar 1. He created WindStar Aviation. His father, Dutch, was the chief pilot," the website said.

Records show the Learjet is now owned by Extra Point LLC, in Delaware. The plane's most recent flight was from Centennial to Pueblo on Jan. 27.

The Learjet was removed from the side of the runway late Thursday night and is being stored at the airport for investigators.

The airport was closed following the incident but was reopened Friday morning.

Concealing Ownership? Good Idea? No

According to the List of Excluded Individuals and Entities (LEIE) it was March 2010 before William A. Mueller, DDS, one of the founders of Small Smiles Dental Centers was excluded from the Medicaid program.

It was August 2010, before Michael A. DeRose, former DDS and another co-founder of Small Smiles Dental Centers was excluded.  Why? Why did it take so long? 

However, now that each of these individual are excluded, it would be illegal for either to hide under a stack of corporations concealing their ownership and control of any clinic or facility that bills Medicaid for services.  Just saying.

Smile Starters Still Abusing Children and Keeping Parents From Going Back With Their Child; After The First Two Visits Of Course.

Here is the story of a child who went to Smile Starters in North Carolina.  Her name is Kathy and she's 3 years old.  This is a sad story.  They make the mother feel as though she's a bad parent, they use the usual scare tactics and they've even blamed the child for not behaving properly.
Smiles Starters is part of the DeRose family of clinics, with Dr. Raf Rivera listed as being the owner.  Dr. Raf was a long time employee of Dr. DeRose and Dr. Ballance. 
When they got into trouble in North Carolina, Dr. Raf came to the rescue, offered up his name and they never missed a beat.  Wonder if DeRose and Ballance have paid the $10 million settlement yet?  If you have a child you has suffered at the hands of these ruthless creatures disguised as a dentist, contact Moriarty-Leyendecker.

The place I take my DD (dear daughter)is called smile starters and they pulled my DD's top 4 out . Caps on all but 1 tooth which was sealed and the bottom 4 has porcelain crowns in the back of them. And now her bottom 4 is going bad . And I cut out almost all sugar brush 3 times or more a day and she only has water or milk nothing else.
This place is the only one that takes Medicaid. And this next appointment I was told I can't go back with her that only 2 appointments the parents are allowed. They had to use a papoose each time cause she kicks.
But now I dread the appointment that is coming up this Friday (July 30, 2010) because they talk very stern to me the other times acted as if I was the worst parent in the world.
If I could find another place I would but there isn't a place that will accept Medicaid And I know they would want to put her through another oral surgery to pull those 4 bottom teeth and she had her first surgery last Dec.
I know her teeth are bad from genetics and they looked rough and I am caught in a hard spot cause I don't want them to report me for neglect and it states that they can if I miss a certain amount of appointments and I already rescheduled it .
And the health departments dental clinic is not equipped to  handle my DD's tantrums she has ( she kicks , scratches, cries, and pukes). She even has these when I brush her teeth.
I wish they was more equipped because they are nice to me about everything and didn't talk harsh to me . As soon as she grows out of these tantrums she has she is going to them.

Now what is it they say about needing to put crowns on teeth to hold the place for the permanent teeth?

I've also seen reports lately where parents are being asked to sign a waiver to let their child go back alone!
