The list above reflects even the part time dentists.  Good!  You just can't play with trash without getting dirty, can you?

In the first case above, CJ-2010-1632, Douglas Durst, DDS has been removed without prejudice, at the request of the plaintiff in fact.  However, as of today,  Dr. Douglas Durst remains on the case filed in February 2011. 

There have been two other Medical Malpractice lawsuits naming Dr. Mathew A. Berg in Oklahoma- CJ-2009-10685 with Charles Goodwin, DDS and CJ-2009-01390 in connection with Dr. Paul Esau and New Smiles, PLLC.   I think this makes Dr. Mathew Arnold Berg the wining Small Smiles dentists with 4.

Settlement

The liability insurance company for Dr. Megann W. Scott offered Briseno $17,500 and she accepted it.  In the end there was 11,339.43 put into an account and "shall not be withdrawn unless ordered by the court"  or given to the child on their 18th birthday.

It took just over 64 days (45 working days) for Dr. Megann's insurance company and Briseno to settle.  I think that's pretty darn quick..  I also noticed in this case the complaint was barely one page long, the answer to the complaint, only one paragraph. 

The Petition: (Filed May 12, 2010) 

     COME NOW, Plaintiff, Jerri Briseno, individually and as parent and next friend of left blank, a minor, for causes of action against Defendants, Small Smiles Holding Company dba Oklahoma Smiles Dental Centers of Oklahoma City ("Small Smiles) and Megann Scott, DDS ("Scott"), state:

     On or about January 26, 2010, [ 5 days after the announced $24 million dollar settlement] minor Plaintiff sought dental care at Defendant Small Smiles.  Defendant Scott, an agent and or employee of Small Smiles rendered negligent care, treatment and services to said minor Plaintiff.  As a result [of] Defendants negligence, the minor Plaintiff sustained injuries in an amount of $17,500.00.

     Wherefore, the Plaintiff's demand judgment against the Defendant and for any other relieve that the court deems proper.

The Answer: (filed May 13, 2010)

     Defendants, Small Smiles Holding Company dba Oklahoma Smiles Dental Centers of South Oklahoma city and Megan Scott, DDS denies generally and specifically each and every allegation contained in the Petition filed herein.

     WHEREFORE, having answered, said Defendants pray the Plaintiffs take nothing herein.

Honestly, the above is all there was to the whole thing.  So they each side filed these two documents with the court, one document says we want $$$ because Dr. Megann Scott did this.  The very next day, Dr. Scott says, no I didn't but here is the exact amount you asked for.

I dunno, but you think maybe things had been happening between the defendant and Dr. Megan Scott and her insurance company long before anything was ever officially filed in court.  I'm just guessing here, but I bet dollars to donuts, it was only filed in court so that the courts could oversee the distribution of the settlement dollars.

What isn't clear is what negligent treatment Dr. Megann Scott delivered.  There appears to be no actions ever taken against her in Oklahoma, but that doesn't mean anything!  Having an action recorded as being taken by a state medical board of any kind, in some states, means you've murdered at least a dozen people and have their hides in your bedroom closet.
