Arizona Mobile Dental Statue–A look back, and peek ahead

At a February 4, 2011 meeting, discussions were held on HB 2233, a Bill introduced by Representative Doris Goodale (R-Kingman) to regulate Mobile Dental Facilities in the state. A stakeholder’s meeting had been held just prior to the meeting; attendees included the dental board, AHCCCS, the Arizona Dental Association and Dr. Ralph Green. The minutes of that meeting said Dr. Green was representing “one of the mobile dental units”. We know that to be ReachOut Healthcare America.
At the stakeholders meeting, held prior to the February dental board meeting, two amendments had been brought forth for HB 2233. The first added a verbal “informed consent”. This would mean the consent for treatment could be given over the phone as long as it was recorded and stored. It also provided two distinct levels of consent; level one authorizing preventative and diagnostic services and the other level for actual treatment.
The second amendment eliminated the two levels of consent in amendment #1 and provided for an audio recorded informed consent, which included a section that redefined the meaning of “informed consent” in Arizona.
At the February 2011 board meeting lobbyist Stuart Goodman said “not to forget the art of politics – taking the ideal and making sacrifices for what is achievable. He also stated, “Bills that add more legislation do work as long as there is consensus among the parties. If there is not consensus, the members start looking for excuses and public safety aspects tent to get lost in the shuffle.”
Goodman recommended a hybrid of the two amendments. He wanted the board to removed the word “permanently” that was included in the original bill that had to do with the “recorded and stored” language it contained. Goodman requested the board move quickly deciding on the language as he was feared the Mobile Dental Bill would be pulled, citing “mobile dentistry would go unregulated another year.” Mr. Kevin Earl, executive director of the Arizona Dental Association, was more concerned about whether a copy of the recording would get submitted to the board if a patients records were subpoenaed. Upon MOTION by Dr. Waite and second by Dr. Morrison, the board gave Stuart Goodman the authority to modify the wording but hold off on modifying the definition of informed consent. They also wanted to meet again with Goodman in another stakeholders meeting and see if they could come to some sort of agreement. 
At the Arizona House Committee on Health and Human Services meeting February 16, 2011, Ralph Green’s lobbyist Gregory Harris signed up in support of HB 2233 but did not speak.
The governor signed the Bill into law April 16, 2011. There was no two tiered approach to consent for treatment included in the final legislation that went into effect January 1, 2012. (Full Text of HB 2233)  ReachOut and Ralph Green, DDS won that battle.
32-1299.25. Informed consent; information for patients
A.  The permit holder of a mobile dental facility or portable dental unit must obtain appropriate informed consent, in writing or by verbal communication, that is recorded by an electronic or digital device from the patient or the parent or guardian of the patient authorizing specific treatment before it is performed. The signed consent form or verbal communication shall be maintained as part of the patient's record as required in section 32-1264.

Morgan Stanely’s Reachout Healthcare Mobile Dental Clinics continue breaking new rules put in place to protect children from their abuse of children

I realize it’s hard to believe someone, i.e. R. Kirk Huntsman, convinced Morgan Stanley that driving up to schools, sending criminally incompetent dentists and employees inside to zap them with as much radiation as possible, restrain children and perform dental procedures with or without consent, then bill the taxpayer was a great idea. But it happened.

Below is an update on the lawsuit filed by Darren and Stacey Gagnon on behalf of their son, who was traumatized by Reachout Healthcare mobile dental clinic employees in Arizona. Imagine the stuff that was too “hot” to include in the following piece.

myfoxphoenixAs we first reported back in June, a mobile dentistry operation is being sued by an Arizona family. They allege their special needs son received unnecessary dental work at school.

Tonight, we revisit the Gagnons, to see how their son Isaac is doing, and update a case that may have already forced the state to make changes in the way dentists do business.

The first time we met the Gagnons, Isaac was kept from our cameras because they might scare him.

This time, we got a chance to watch Isaac color a picture for his friend's birthday party.

Isaac gets night terrors after what happened to him.

"He was diagnosed with post-traumatic stress disorder… he was a very fragile emotionally child in the first place," says mom Stacey Gagnon.

Fragile in the first place because Isaac was adopted after surviving severe shaken baby syndrome.

"He was horribly injured as an infant including five skull fractures."

But Isaac had come a long way with the Gagnons.

"We saw this little boy emerge who loved tractor trucks and run and play in the dirt."

That ended about a year ago.

"October 4th, Isaac was seen by a dentist at school," says dad Darren Gagnon.

A dentist from Big Smiles, a part of Reachout Healthcare America, treated Isaac inside his school's art room.

"He says you know the dentist man got me… we didn't know what had happened."

Reachout paperwork in Isaac's backpack showed the boy had been given two pulpotomies - or baby root canals - and 10 X-rays. Something his parents say they never approved. Isaac's mother called Reachout for an explanation.

"They told me it was a training error on their part," says Stacey.

Everything the Gagnons allege is part of this lawsuit they filed against Reachout, Big Smiles, and two dentists.

It alleges among other things, battery, fraud, intentional infliction of emotional distress and racketeering.

"We found out from the school they had actually held Isaac down for somewhere in the neighborhood of 40 to 45 minutes, that they physically restrained him to do the work on him because obviously he was in a lot of pain," says Darren.

The two dentists named in the lawsuit include Doctor Ralph Green who works at Reachout Corporate offices in north Phoenix -- and Doctor Alvin J. Coon, who performed the work on Isaac.

Article maligned my dental clinic

Regarding "Dental clinics merit scrutiny" (Editorial, Tuesday):
I believe the editorial's characterization of my dental practice as a scam was misleading and irresponsible. It is simply not true.
Grouping my practice with Onsite Dental, which fraudulently billed Medicaid and whose owner's license has been suspended, is egregious and reckless. It threatens my practice and places thousands of Arizona children at risk of not having access to dental care.

For the past decade, I have operated a mobile dentistry practice that has served more than 200,000 of the more than 1 million Arizona schoolchildren who do not receive dental care. The roughly 200 dentists I have employed over the past 10 years are dedicated to the mission of helping these kids.

The Republic reported that $12.5 million was collected from AHCCCS during the past two years ("Mobile dental clinics drawing scrutiny," Sunday), leaving the reader with the impression that the amount collected was inflated or unwarranted. The newspaper failed to mention that more than 105,000 children received much-needed care for that amount at a rate of less than $120 per child.

As a large Medicaid provider, my practice is continually audited by the dental directors of multiple insurance companies as well as government regulators. We are proud of our record and hold ourselves to the highest ethical standards.

ReachOut Healthcare America–Big Smiles Mobile Dental Clinics are a danger to public health! Another example!


ReachOut Healthcare America under fire again. When will those who can, do something?

Though no name of the company operating the mobile dental clinic is mention, it is ReachOut Healthcare America, based in Farmington, MI.

ReachOut Healthcare America is under investigation by Senator Charles Grassley’s office. (see letters Sen. Grassley has sent to ReachOut on the right)

If you work or have worked for ReachOut Healthcare America and do nothing to protect people like Andrew in this story, or little Isaac in Arizona it’s your duty to speak out. Please do so, everyday children, the handicapped and the elderly are being abused! Do something! I beg of you!

To WOOD – TV News 8:

What was the point of this story by WOOD-TV News 8 if they wouldn’t mention the name of the company?  Why did News 8 leave the investigation of this company out of the story? It’s your duty as well to warn the public that a company owned by Morgan Stanley is doing this to the most vulnerable people in America.

If I weren’t posting the name, right here, right now, no one would have a clue what company did this to Andrew. For God’s sake people, wake the hell up, get off your butts and speak up!

Healthy Senior Dental, LTD = ReachOut Healthcare America

I’ve said on here more than once that not only are children in danger, so are grandma and grandpa in the nursing homes.

The same people who mistreated this poor child in AZ are the same names associated with Health Senior Dental, LTD. However, I’m sure nothing like this happens with Health Seniors Dental because they say they have a “perfect legal and ethical background of no liability claims every filed” and “all dental decisions are made by state licensed dentists with perfect ethical records.” (see below)

What are the chances of Dr. Elliot P. Schlang, Dr. Ralph Green and Michael P. Howell having another company unrelated to ReachOut Healthcare and Morgan Stanley?  None, nada, zip, zilch, zero.

I’m not seeing any actions being taken other than giving them passes for further abuse of children.
